LB 530: Improving Foster Care and Extending the Nebraska Children’s Commission

As introduced: By July 1, 2013, the Division of Children and Families Services of DHHS shall implement the reimbursement rate recommendations of the Foster Care Reimbursement Rate Committee as reported to the Legislature.  The Division of Children and Families Services shall develop a pilot project to implement the standardized level of care assessment tools recommended by the Foster Care Reimbursement Rate Committee.

Prior to April 1, 2013, DHHS shall review the pilot project and provide to the Health and Human Services Committee of the Legislature recommendations and any legislation necessary to adopt the recommendations regarding the adaptation or continuation of the implementation of a statewide standardized level of care assessment.  DHHS shall provide the full reimbursement rate to contracted provider agencies in the pilot program.

On or before January 1, 2016, the NE Children’s Commission shall appoint a Foster Care Reimbursement Rate Committee to make recommendations to the Health and Human Services Committee of the Legislature for a standard statewide foster care reimbursement rate structure for children in foster care in NE.  The commission shall reconvene the committee every four years for the same purpose.  The members and role of the committee is further defined.

The duration of the NE Children’s Commission is extended until June 30, 2016 (overturning the NE Children’s Commission original termination date of June 30, 2014).

As Amended:
If the NE Children’s Commission is terminated, recommendations to the Foster Care Reimbursement Rate Committee shall be made and vacancies filled by the Governor with the approval of a majority of the Legislature.

The NE Children’s Commission shall review and provide a progress report on the pilot project by October 1, 2013 to DHHS and electronically to the Health and Human Services Committee of the Legislature and on December 1, 2013, with a final report and final recommendations of the commission to be submitted to DHHS and electronically to the Health and Human Services Committee of the Legislature on February 1, 2014.

Estimated Fiscal Impact: There is no fiscal note for FY 2013-2014.  The fiscal note for FY 2014-2015 is $2,237,394, with $2,023,394 coming from the general funds and 214,340 coming from federal funds.
