LB 385: Foster Care Fairness Act

As introduced: When determining the suitability of placement, family participation and/or issuing a foster care license, the Department of Health and Human Services will not discriminate on the basis of race, religion, sex, sexual orientation, gender, identity, disability, marital status, or national origin.  Instead, all placement decisions will be based on the health, safety and well-being of the child.

As Amended: When determining the suitability of a foster care placement of a juvenile in, or issuing a license, waiver, variance or approval of a kinship home or a relative home, DHHS will not discriminate on the basis of race, religion, sex, sexual orientation, gender, identity, disability, marital status, or national origin of the caregiver.  Foster care placement decisions shall be based upon the health, safety, well-being and best interest of the child.
